    daiichi sankyo judgement

    Daiichi Sankyo fined $39 Million by US Justice Department

    Deal reached between Daiichi Sankyo and US Justice Deptartment for illegal kickbacks

    Daiichi Sankyo, the manufacturer of the high blood pressure medication Benicar, has reached a deal with the United States Justice Department in which the company will pay a fine of $39 million.  The fine is being paid by the U.S. subsidiary of Daiichi Sankyo for giving illegal kickbacks to physicians for promoting and prescribing their products.  The company was paying physicians to promote and prescribe Azor, Benicar, Tribenzor, and Welchol.  The Justice Department claims that Daiichi Sankyo paid physicians for “speaking fees” when in reality these physicians were simply writing more prescriptions for Daiichi medications.  The kickbacks were paid for a period between January 1, 2005, and March 31, 2011, through the Daiichi-sponsored Physician Opinion & Discussion programs.  According to the Justice Department, the speaking fees paid by Daiichi Sankyo violate the Anti-Kickback Statute, which prohibits payments that are intended to sway a physician’s prescribing decisions.  This is just the latest legal trouble that Daiichi Sankyo has encountered, as many American consumers are filing lawsuits against the company for adverse side effects they have suffered as a result of using Benicar.

    Undisclosed Gastrointestinal Side Effects for Olmesartan based drugs

    gastrointestinal side effects from benciarIn the United States, drug manufacturers have a duty to test their products for health risks and warn consumers of these risks.  When these manufacturers fail to do so, they are held liable for injuries that result from the consumption of their products.  Such is the case with Daiichi Sankyo and its highly profitable medication Benicar.  The number of Benicar lawsuits continues to mount as more and more consumers of Benicar develop a rare gastrointestinal condition known as sprue-like enteropathy.  Sprue-like enteropathy is similar to Celiac disease in that symptoms include chronic diarrhea, vomiting, and excessive weight loss.  The main difference between sprue-like enteropathy and Celiac disease is that sprue-like enteropathy can only be alleviated by stopping the consumption of Benicar.  Sprue-like enteropathy is a very serious condition and many consumers were hospitalized as a result of developing the condition.  In addition, many of these consumers developed long-term damage to their intestines as a result of using Benicar.

    Benicar, Benicar HCT, Azor, and Tribenzor Lawsuits

    Daiichi Sankyo’s past actions have been both illegal and unethical, and they show that the company does not care about anything but its bottom line.  If you have used Benicar and have suffered from gastrointestinal issues, you have the opportunity to hold Daiichi Sankyo legally accountable for its actions.  Daiichi Sankyo had a duty to adequately test Benicar for health risks and warn consumers of these risks, but the company failed to do so.  The attorneys at Abbott Law Group are currently reviewing claims on behalf of those who used Benicar and were subsequently diagnosed with sprue-like enteropathy or experienced any of the symptoms associated with sprue-like enteropathy.  Please contact us today to find out if you may be legally entitled to compensation for past and future medical bills, lost wages, pain and suffering, and other damages.

    villous atrophy lawsuit

    Villous Atrophy Caused by Benicar

    Benicar (olmesartan medoxomil) is a medication that was approved by the Food and Drug Administration (FDA) in 2002 for individuals with hypertension. Benicar is manufactured by Daiichi Sankyo and distributed by Forest Laboratories.  However, many of the hypertension patients have developed digestion issues and one the main digestive conditions is villous atrophy. This is a condition that severely reduces the surface area of the small intestines making it difficult for patients taking them to absorb nutrients and water from digested food. The symptoms include rapid weight loss since no nutrients are absorbed from food, chronic diarrhea, malnutrition and chronic dehydration.

    Link between Benicar and Villous Atrophy

    Villous AtrophyRecently, medical researchers have discovered that there is a strong link between villous atrophy and Benicar.  In many cases, it has been found that once the patient stopped taking the drug, the symptoms disappeared. There is substantial evidence that the usage of Benicar causes gastrointestinal damage. Since Daiichi failed to provide warning labels to indicate villous atrophy as one of the side effects of Benicar, you have the right to file a lawsuit against the pharmaceutical giant.

    If you or a loved one suffered from villous atrophy after taking Benicar, the Abbott Law Group could help you to file a Benicar lawsuit against Daiichi.  The firm has over thirty years trial experience with highly trained and qualified attorneys.  Our goal is to seek justice and to determine any compensation to which you may be entitled.

    Benicar Celiac-like Disease

    Benicar Celiac-like Disease

    Benicar Celiac-like Disease seen in patients

    A large number of Americans take Benicar (Olmesartan mexodoxomil) for hypertension. It is also used to reduce the effects of serious cardiovascular problems. Although this prescription medication provides good benefits to those suffering from high blood pressure, it has numerous side effects, which can cause serious health problems.

    Benicar Misdiagnosed for Celiac Disease

    Benicar causes some more prevalent health conditions such as gastrointestinal problems. It also causes sprue-like enteropathy, which has symptoms similar to Celiac disease and wheat allergy. Since these symptoms are similar to the ones in Celiac disease, many doctors have misdiagnosed their patients suffering from sprue-like enteropathy. Another serious similar condition is villous atrophy, which reduces the ability of the small intestines to take in nutrients. It may take several years for people suffering from sprue-like enteropathy and villous atrophy to notice the symptoms and to be properly diagnosed.

    The symptoms in these diseases include:

    • Chronic diarrhea,
    • Substantial weight loss, and
    • Severe malnutrition.

    The U.S Food and Drug Administration (FDA) requires drug companies to include warning labels on drugs with adverse side effects. Daiichi Sankyo, the manufacturer of Benicar, failed to warn about the side effects of Benicar. After the FDA analyzed data provided by Mayo Clinic, the agency issued a drug safety alert in July 2013. The FDA discovered that several Benicar users were experiencing severe side effects from the medication and were receiving treatment for the wrong condition for a very long time due to a misdiagnosis. In most of the cases, doctors initially thought that users were suffering from Celiac disease until conducting blood tests proved otherwise. Doctors also discovered that the Celiac-like symptoms reduced when patients stopped taking Benicar.

    Other Benicar Side Effects include:

    • Vomiting;
    • Kidney complications;
    • Nausea;
    • Chest pain;
    • Irregular heartbeat;
    • Angioedema;
    • Abdominal pain;
    • Arthritis;
    • Hair loss; and
    • Liver impairment

    Benicar Celiac LawsuitBenicar Celiac-like Disease Class Action Lawsuit

    A number of people have filed class action lawsuits against Daiichi Sankyo, the manufacturer, and Forest Laboratories, the distributor of Benicar. According to the legal experts, tens of thousands of people have filed lawsuits for Benicar and other olmesartan-based medications (Benicar HTC, Tribenzor, Azor) due to the numerous serious side effects suffered by users. If you, a friend or a relative has suffered from Benicar side effects, it’s time to seek justice by filing a lawsuit against the pharmaceutical giant Daiichi and its affiliates.

    So far, the allegations from other lawsuits are mounting and include the following:

    • Concealing critical information and putting the lives of Benicar users at risk;
    • Failing to conduct adequate research before releasing Benicar to the market; and
    • Manufacturing, promoting and selling a defective and dangerous product

    If you file a class action lawsuit, you may get compensation for past and future medical expenses, damages for pain and suffering, as well as for lost wages. Additionally, a lawsuit can hold the manufacturer responsible for releasing a defective drug in the market, and discourages other drug companies from doing the same.

    Our experienced lawyers at the Abbott Law Group will offer free consultation and help you to file a Benicar class action lawsuit. We have over thirty-five years of experience and know what it is like to go against pharmaceutical giants like Daiichi. Benicar Stomach problems leading to diarrhea

    Benicar and Chronic Diarrhea Problems

    Problems with Benicar starting with Chronic Diarrhea

    Benicar has been in the news lately, due to the Food and Drug Administration (FDA) warning that was publicized in June 2014. The warning stated that there were undisclosed side effects that should be on the product’s labeling, and that serious gastrointestinal problems might be related to its use. This has been a relief to many, because it is now disclosed that one of these Benicar side effects is chronic diarrhea.  The injuries from taking Benicar have caused many people to file lawsuits against the manufacturer Daiichi Sankyo.

    Benicar chronic Diarrhea ProblemsMisdiagnosis of Celiac Disease

    Patients who took Benicar and are experiencing severe side effects may end up receiving treatment for other problems like diarrhea and weight loss. In addition, the side effects of Benicar may mirror those of Celiac disease, where people have an allergic reaction to wheat or gluten.  Generally, doctors are very familiar with Celiac disease, which is why they first test many patients taking Benicar for the disease before discovering that their initial diagnosis was inaccurate. Most times, after being tested for Celiac disease, the results come back negative for gluten allergies.

    Digestion Issues Related To Chronic Diarrhea

    When chronic diarrhea from Benicar persists for more than a couple of months, severe weight loss and dehydration may become life threatening. Not only for the obvious reasons that the patient is rapidly losing weight, but also that the patient may not be able to properly digest food.  Many patients have shown signs of malnourishment and vitamin deficiency because of constant diarrhea problems related to Benicar.  The key is to immediately receive treatment and fluids for dehydration to prevent further complications from occurring.

    Ulcers And Diverticulitis May Complicate Chronic Diarrhea Even Further

    The chronic diarrhea can get so severe that ulcers or perforations in the stomach lining may appear and the diarrhea may leak through the perforations or holes in the stomach creating acute infection.  It may be necessary to prescribe heavy dosages of antibiotics and surgery to repair the stomach lining and stop the spread of stomach bile from leaking into the internal organs. There have been reports of heart attacks related to diverticulitis, which is the formation of pouches (diverticula) that become inflamed within the walls of the bowels, mostly the large intestine or colon.

    Legal Option To Consider

    If you or a loved one has been the victim of chronic diarrhea or other severe gastrointestinal problems because of taking Benicar, you should contact a product liability attorney immediately. The Abbott Law Group has a team of lawyers who are familiar with the laws that relate to your issue and will guide you through a lawsuit for the injuries you have suffered.  You may be able to recover damages for lost wages, medical bills, pain and mental anguish, and any other compensation to which you may be entitled. Why wait? The longer you wait, the more difficult it may be to file your case, as there are time constraints known as “statutes of limitation.”  If we do not file your case before the statute of limitations expire, you may be forever barred from bringing a claim against the manufacturer of Benicar. Please call us today.

    Benicar Class Action Lawsuits

    Qualifying for a Benicar Class Action Lawsuit

    There are already several Benicar Class action and individual lawsuits that have been filed. Many of the patients who had experienced Sprue-like enteropathy, chronic diarrhea, and gastrointestinal problems have banded their lawsuits together into one class action.  These cases will be taking place in the U.S. District court for the District of New Jersey.

    Benicar FDAOn June 24, 2014, the US Food and Drug Administration (FDA) released some safety information concerning the use of Benicar (Olmesartan), a blood pressure lowering drug. The information was concerning the association between this medication and heart attack. After reviewing the side effects Benicar for some time now, they are convinced that no clear evidence of increased cardiovascular risks associated with use of this medication.

    Despite the findings from the FDA, other available evidence indicate the side effects Benicar may indeed cause severe cardiovascular events including heart attack, stroke as well as death albeit only rarely. Besides, this angiotensin receptor blocker (ARB) has been found to predispose users to Sprue-like enteropathy characterized by chronic gastrointestinal problems, severe diarrhea and sudden weight loss.

    Benicar Class Action Vs Individual Lawsuits

    Are you wondering whether to join a Benicar class action or file individual Benicar lawsuit? There are pros and cons of both of these kinds of lawsuits. When taken into overall consideration, individual lawsuits may be filed but normally come with a large attorney fee. Benicar class action lawsuits generally are done on a contingency fee basis, so there is no up front cost to join and the lawyers get paid out of the Benicar settlement.

    Another advantage of a Benicar class action lawsuit is that plaintiffs can avoid the burdens associated with filing individual lawsuits. This is because they can join up, consolidate their individual claims, and select a legal representative to handle the consolidated cases in the court of law. This is very cost effective as the personal injury lawyer or law firm is paid legal fees for the class action lawsuit and not for individual lawsuits.

    If a Benicar class action lawsuit is successful and results in Benicar settlement then the lawyers take a percentage and the rest of the money is shared among the plaintiffs. Compared to individual lawsuits the amount of compensation each plaintiff will get is usually smaller. If your injuries were extremely severe, the amount of compensation may not even be enough for treatment. However, for minor injuries, class action may be the best option.

    Do You Need Help With Benicar Class Action

    Have you been injured due to the use of Benicar, or has anyone in your home suffered damages as a result of treatment with this drug? If so then you should act quickly and gather the necessary paperwork to see if you qualify for a Benicar class action lawsuit. Benicar Side Effects Lawsuit

    Benicar Side Effects for a Benicar Lawsuit

    What to Know About the Adverse Side Effects of Benicar?

    The adverse side effects of Benicar (olmesartan medoxomil) may become severe in just a matter of months, and you should know about them. This drug was designed to help patients with high blood pressure. The adverse side effects of the drug, however, include sprue-like enteropathy, which makes you feel sick all the time. Patients have reported experiencing severe diarrhea, which can lead to abnormal weight loss.

    Adverse Benicar Side Effects: What Happens When Treatment Goes Wrong?

    Benicar Side EffectsThe first Benicar lawsuit was registered by a 65-year old male patient. He had a history of hypertension, reported severe diarrhea, and lost 25 pounds over three months after he started taking the drug.

    Many clinical trials now conclude the same thing. They all point to the fact that Benicar can cause some really bad side effects in some people. The most common side effect is sprue-like enteropathy, which eventually can cause tremendous weight loss.

    How Severe Can It Be Living With Benicar Side Effects?

    Benicar may cause vomiting and severe diarrhea.  It may also cause loss of appetite as it destroys the villi in the stomach lining, which allow the digestion of food.  If Benicar damages your stomach lining badly enough, the damage may not be reversible. This could lead to malnourishment issues.  If you have any of these symptoms and you take Benicar, you should seek immediate medical attention.

    Can the Side Effects of Benicar Be Treated With Medical Attention?

    In general, patients often fail to link their symptoms to the drug, thinking they are just normal digestion problems. It is possible,though, to overcome sprue-like enteropathy, provided you treat it properly and at the right time. Patients who experienced heavy weight loss, gained back weight after they stopped taking the drug.

    Have you taken Benicar for over 3 months?  Have you noticed a sudden drop in weight after you started this prescription medicine? If you answered yes to both of those questions you may want to speak to one of our product liability attorneys about a Benicar Lawsuit.

    Benicar Attorney

    Benicar Attorney for a Benicar Lawsuit

    Benicar ttorneys are drug injury litigation specialists and you may have to hire such a professional, if you have been harmed by Benicar. If you are not aware of the FDA’s recent warning announcing Benicar’s (olmesartan medoxomil) severe adverse side effects, you should talk to your doctor as soon as possible.

    Benicar Attorney Should Be Contacted to Get The Best Recommendations

    Benicar Attorney LawsuitThe drug Benicar has been seen to cause sprue-like enteropathy, essentially severe diarrhea and abrupt weight loss, due to a severe disorder of the digestive tract. If you were not aware of the negative side effect of Benicar, then you should be made aware of  how severely Benicar could affect your health.  Benicar is a drug for controlling high blood pressure. If you have experienced the severe adverse effects of Benicar, you should consider contacting our lawyers with the experience to help you.

     When is it Appropriate to Approach a Benicar Attorney?

    With your doctor’s support, you need to determine if there is a link between the Benicar you have been taking and your prevailing health complications. According to the FDA, the side effects of Benicar can take months or even years to show up.

    The first negative side effect is typically severe stomach cramps. You may develop a severe apathy for foods. Benicar may then cause a condition called sprue-like enteropathy, which mimics the disease called Celiac Sprue.

    What is Celiac Sprue? It’s also known as gluten sensitive enteropathy. Some people with this disorder of the digestive tract can’t tolerate gluten. If these patients eat gluten knowingly or unknowingly, they develop an inflammatory condition which disturbs the mucosa of the intestine, affects the internal structure of the intestine, and can contribute to substantial weight loss. The overall condition is highly unfavorable, as it affects the digestion and absorption of the food nutrient.

    Sprue-like enteropathy may also gradually lead to severe loss in weight, as patients taking Benicar suffer. If you think your current health condition resembles the symptoms mentioned above, you should consider making an appointment with our lawyers experienced with Benicar personal injury lawsuits.

    What Sort of Things You Should Make a Note of Before Approaching a Benicar Attorney?

    • The date when you noticed the first symptom of Benicar.
    • The date you first started taking Benicar.
    • What type of complications you’re experiencing.
    • Were you warned about the drug’s probable side effects?
    • Are you suffering from chronic diarrhea?
    • Do you have your doctor’s support for this data?
    • Did you see improvement after the discontinuation of the drug?

    If you or someone you know has been harmed by Benicar, you deserve the best possible legal advisor. The Abbot Law Group has an experienced team of lawyers and has been handling litigation and trials for more than 30 years.  Call the Abbott Law Group at 877.292.1500 (or fill out the online form) to receive a free, confidential case evaluation. If your case meets the criteria for eligibility to file a Benicar class action lawsuit, the Abbott Law Group will fight to obtain the maximum compensation to which you may be legally entitled.

    Benicar Sprue-Like Enteropathy

    Benicar Sprue-Like Enteropathy Lawsuit

    If you, or a loved one, have experienced health problems while taking or after stopping Benicar (olmesartan medoxomil), it may be as a result of a hitherto unannounced adverse effect of Benicar, sprue-like enteropathy (severe, chronic diarrhea with substantial weight loss), and you may be eligible for compensation.

    Benicar-Sprue-like-enteropathyOn July 3, 2013, the Food and Drug Administration (FDA) issued a warning that the olmesartan-based drugs Benicar, Tribenzor, and Azor cause sprue-like enteropathy. Benicar is an angiotensin receptor blocker that is used to treat hypertension (a fancy way of saying it’s high blood pressure medication). It’s also sometimes prescribed along with other high blood pressure medications.  Among the eight marketed angiotensin II receptor blockers, olmesartan is the only one that has been linked to sprue-like enteropathy.

    Over the course of months or years, Benicar may cause the following symptoms of sprue-like enteropathy:

    1. Problems in both the digestion and absorption of food
    2. Destruction of intestinal villi
    3. Damage to the intestines’ mucosal lining
    4. Flattening of the intestinal lining

    Many cases of Benicar-induced sprue-like enteropathy have been misdiagnosed as Celiac Disease (gluten intolerance). This has resulted in severe health complications and delayed diagnoses. The symptoms of Benicar sprue-like enteropathy are similar to those experienced by people suffering from Celiac Disease, however, unlike Celiac Disease, a gluten free diet does not improve the symptoms. The symptoms of Benicar sprue-like enteropathy only subside if the medication is completely discontinued, and they include:

    1. Rapid and excessive weight loss
    2. Vomiting
    3. Abdominal pain
    4. Fatigue
    5. Bloating
    6. Nausea
    7. Anemia
    8. Enlarged gall bladder
    9. Villous atrophy – erosion of the villi (hair like lining of the small intestines).
    10. Elevated white-blood-cell count
    11. Chronic diarrhea
    12. Dehydration
    13. Cardiovascular problems

    If you, or someone you know, have experienced any of the above adverse side effects after taking Benicar, you should contact your healthcare professional immediately. It is important to note that the symptoms may sometimes take months or even a years to develop.

    Other potential side effects of Benicar include:

    1. Difficulty swallowing
    2. Vertigo
    3. Difficulty breathing
    4. Kidney failure
    5. Abdominal pain
    6. Rhabdomyolosis (breakdown of muscle tissue)
    7. Fetal damage in pregnant women
    8. Hyperkalemia (elevated potassium level)
    9. Sinusitis
    10. Dizziness
    11. Bronchitis
    12. Back pain
    13. Flu-like symptoms
    14. Hematuria (blood in the urine)

    According to the FDA, in 2012 approximately 10.6 million prescriptions for Benicar and similar blood pressure medications containing the same active ingredient were dispensed. Approximately 1.9 million individuals received a prescription of the above olmesartan-containing medications from United States outpatient retail pharmacies.

    Should You File A Benicar Sprue-like Enteropathy Lawsuit?

    If you have, or someone you know has, suffered from Benicar sprue-like entropathy or any of the other above serious side effects of using olmesartan, you may be legally entitled to compensation for your suffering, medical bills, pain, lost income, and other losses.  Call us today to find out if you may qualify for a Benicar class action lawsuit.

    Benicar Weight Loss

    Benicar Weight Loss Lawsuits – Seek Professional Help

    Until recently, Benicar (olmesartan medoxomil) was one of the most popular medications to treat hypertension (high blood pressure) in healthy individuals. However, this medication has attracted many complaints and lawsuits because of an adverse side effect called sprue-like enteropathy (severe, chronic diarrhea with substantial weight loss). This is a chronic intestinal condition characterized by severe weight loss and chronic diarrhea. Thus, Benicar weight loss lawsuits have been quite common.

    In July, 2013, the Food and Drug Administration (FDA) issued a warning and ordered various drug manufacturers using olmesartan in their drugs to include new warnings regarding the risk of this condition on the labels.

    It should be mentioned that not every person suffers from complications after taking this medication, while some do experience only mild side effects, such as dizziness.

    However, there are people who have suffered severe adverse reactions, including sprue-like enteropathy. Sometimes these problems are confused with Celiac Disease, because symptoms are quite similar.

    Some of the most common adverse symptoms of sprue-like enteropathy include:

    • Benicar Weight Loss LawsuitNausea & vomiting
    • Severe, chronic diarrhea
    • Fatigue and dehydration
    • Substantial weight loss
    • Stomach pain

    If you or anyone you know takes Benicar and is experiencing any of these symptoms, you should seek medical help immediately.

    On July 3, 2013, the FDA warned there was clear evidence of a direct association between olmesartan and sprue-like enteropathy. In addition to this, the FDA also reported there were some cases of chronic diarrhea, severe weight loss, and intestinal inflammation among patients who were taking Benicar and other forms of the generic drug.

    Moreover, it was also reported that, in each case, the condition of these patients improved when they stopped taking Benicar. The FDA has advised medical professionals to discontinue the use of Benicar in patients who experience such side effects.

    Reason for Benicar Weight Loss Lawsuits

    Since the medical community has become aware of the association between serious complications and Benicar, patients have continued to report severe symptoms. Due to the severity of these side effects, patients have started questioning whether doctors should have prescribed Benicar in the first place.

    Patients want to know if the drug manufacturer knew about the potential complications of using this drug. This has led to numerous Benicar weight loss lawsuits. Patients also want to know what steps the manufacturer has taken to warn patients about the risks associated with Benicar. It is argued that the manufacturer could have done more to prevent serious complications from affecting so many patients.
